Piphany Terms of Service

These Terms of Service ("Terms") govern your access to and use of Piphany, operated by 1media LLC ("Piphany," "we," "us," or "our").

By using Piphany, you agree to these Terms. If you do not agree, do not use Piphany.

1. Piphany Is a Reflection Tool

Piphany is an AI-powered journaling and reflection companion. It may help you reflect, organize thoughts, notice patterns, and prepare for conversations with a therapist, coach, or trusted support person.

Piphany is not therapy, medical care, diagnosis, treatment, crisis counseling, emergency monitoring, or an emergency service.

2. Emergency and Crisis Disclaimer

Do not use Piphany for emergencies.

If you are in immediate danger, may harm yourself, may harm someone else, or need urgent help, call 911 or 988 in the U.S., or contact local emergency services.

Piphany does not guarantee that it will detect crisis situations, escalate risk, contact emergency services, or notify a practitioner.

3. Eligibility

You must be at least 18 years old to use Piphany.

By using Piphany, you represent that you are legally able to agree to these Terms.

4. AI Limitations

Piphany uses artificial intelligence. AI can misunderstand, hallucinate, omit important context, or generate responses that are not appropriate for your situation.

You are responsible for evaluating Piphany's responses and deciding whether to rely on them. Do not rely on Piphany for medical, mental health, legal, financial, emergency, or crisis advice.

5. Your Content

You may submit reflections, messages, notes, journal entries, or other content to Piphany ("User Content").

You retain ownership of your User Content. You grant Piphany the right to process, store, transmit, analyze, summarize, and display User Content as needed to provide, secure, support, and improve the service.

Do not submit content that you do not have the right to provide or that violates the rights of another person.

6. Practitioner Sharing

If practitioner sharing is available, you may choose to authorize Piphany to share summaries or selected reflection information with a therapist, coach, or other practitioner.

Practitioner sharing is optional. You may revoke future sharing as described in the Privacy Policy or product settings.

Piphany is not responsible for how a practitioner uses, stores, interprets, or discloses information after receiving it from Piphany.

7. Acceptable Use

You agree not to:

• Use Piphany for emergencies or crisis response.
• Use Piphany to harass, abuse, threaten, impersonate, or exploit others.
• Attempt to reverse engineer, scrape, overload, or disrupt the service.
• Submit unlawful, infringing, or malicious content.
• Use Piphany to generate spam, deceptive messages, or illegal content.
• Misrepresent Piphany as a licensed therapist, clinician, medical provider, or emergency service.

8. SMS/MMS Messaging Terms

By providing your mobile phone number and opting in, you agree to receive recurring automated SMS/MMS messages from Piphany at the number you provide.

Messages may include onboarding messages, journaling check-ins, reflection prompts, account notifications, replies to user-initiated messages, links to app summaries or settings, help responses, and opt-out confirmations.

Users opt in through a public Piphany web form, including the SMS consent page or early-access page on https://piphany.net, by entering a mobile number and actively agreeing to receive SMS/MMS messages from Piphany.

Consent is not a condition of purchase.

Message frequency varies based on your preferences, your interactions, and service needs.

Message and data rates may apply.

You may opt out of SMS/MMS messages at any time by replying STOP.

You may receive help by replying HELP or contacting support@piphany.net.

Supported carriers are not liable for delayed or undelivered messages.

Piphany is a journaling and personal reflection app. Piphany is not a medical provider, therapist, crisis service, or emergency service. If you are experiencing an emergency, call 911 or your local emergency number.

9. Fees and Paid Plans

Piphany may offer free, trial, early access, or paid plans. Pricing, billing, renewal, and cancellation terms will be provided at the time of purchase.

10. Intellectual Property

Piphany, including its software, design, prompts, workflows, branding, trademarks, logos, and content, is owned by Piphany or its licensors.

You may not copy, modify, distribute, sell, or exploit Piphany except as permitted by these Terms.

11. Service Changes and Availability

Piphany may change, suspend, limit, or discontinue any part of the service at any time.

We do not guarantee that Piphany will be uninterrupted, error-free, secure, or available at all times.

12. Termination

We may suspend or terminate access to Piphany if you violate these Terms, create risk, abuse the service, or use Piphany in a way that may cause harm or legal exposure.

You may stop using Piphany at any time.

13. Disclaimer of Warranties

Piphany is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory.

14. Limitation of Liability

To the maximum extent permitted by law, Piphany and 1media LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, emotional distress, or service interruption arising from use of Piphany.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

15. Governing Law

These Terms are governed by the laws applicable in the jurisdiction where 1media LLC is organized and operates, without regard to conflict of law principles.
